The County Court has jurisdiction over all defendants accused of committing crimes that have been designated by state law as misdemeanors. A misdemeanor is a criminal offense that in punishable by imprisonment in a county correctional facility. Law enforcement officials may arrest or issue the defendants a summons for notice to appear before the court. Noncriminal offenses such as county ordinances, municipal ordinances and infractions are handled under the County Court. Misdemeanors are divided into degrees and have maximum penalties and fines as described below in Florida Statues, Chapter 775. This chapter contains all criminal penalty laws.
  • A first degree misdemeanor is punishable by a term of imprisonment not to exceed 1 year in a county jail and by a fine not to exceed $1000.
  • A second degree misdemeanor is punishable by a term of imprisonment not to exceed 60 days in the county jail and by a fine not to exceed $500.
Other charges handled in misdemeanor court:
  • County and municipal ordinances which are defined as local regulations passed by a county or municipality which are punishable by a fine no more than $500 and/or imprisonment in a county jail for less than 60 days.
Misdemeanor court is held on Monday and Tuesday starting at 9:00 am before the Honorable Wesley R. Poole. Court sessions are open to the pubic unless specifically closed by the Judge. Please call the misdemeanor department at 904-548-4613 for dates and times of any special hearings. No Children are allowed in the court room. Proper attire is required; no shorts allowed.
Court Appearance
Once a court date has been set on a misdemeanor case the Clerk's Office cannot change it. If there is a problem you will need to contact your attorney.
Failure to Appear In Court
A warrant may be issued for your arrest and any bond that you have posted may be forfeited when you fail to appear for court. If you are arrested because of a failure to appear warrant you may be held in jail without bond.
